Availability of specific products, coverage options, and pricing varies by state and is determined solely by our insurance provider partners. If you request information about Medicare-related plans, you may be connected with licensed Medicare insurance agents. You may not be eligible for all Medicare products, and eligibility is determined by the issuing insurance company in accordance with applicable law.

The CreditHaven name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CreditHaven or its affiliates. You may not use such marks without the prior written permission of CreditHaven.

CreditHaven has no control over, and assumes no responsibility for, the content, privacy policies, terms of use, or practices of any third-party websites or services. When you leave the CreditHaven platform, you do so at your own risk and should review the terms and privacy policies of any third-party site you visit.
Your interactions with third-party service providers found on or through the Services, including payment for and delivery of financial products and services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third-party provider. CreditHaven shall not be responsible or liable for any loss or damage incurred as the result of any such dealings.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CREDITHAVEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
CREDITHAVEN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT THE INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE, RELIABLE, OR COMPLETE, OR THAT DEFECTS WILL BE CORRECTED.
CreditHaven does not provide insurance, financial, legal, or tax advice. Any information about insurance products, coverage options, rates, or other financial matters is for general informational and educational purposes only and should not be relied upon as professional insurance or financial advice. You should consult with qualified insurance, financial, legal, or tax professionals before making any insurance purchase or financial decision.
CreditHaven does not guarantee that you will receive any offers, be approved for any financial products, or achieve any particular financial outcomes by using the Services. Interest rates, terms, and availability of financial products are determined solely by our third-party partners and are subject to change without notice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREDITHAVEN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL CREDITHAVEN'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO CREDITHAVEN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT CREDITHAVEN HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
You agree to defend, indemnify, and hold harmless CreditHaven, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Binding Arbitration. You and CreditHaven agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.
Arbitration Rules. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules or, if applicable, its Commercial Arbitration Rules. The arbitration will be conducted in the English language and will take place in the state of Delaware, unless otherwise agreed by the parties.
Class Action Waiver. YOU AND CREDITHAVEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and CreditHaven agree otherwise, the arbitrator may not consolidate or join more than one person's claims.
Jury Trial Waiver. YOU AND CREDITHAVEN HEREBY WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to CreditHaven within 30 days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of the arbitration agreement.
If 25 or more similar arbitration demands are asserted against CreditHaven by the same or coordinated counsel ("Mass Arbitration"), the following procedures shall apply:
If you are part of a Mass Arbitration, resolution of your dispute may be delayed.
CreditHaven may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

You may deactivate your account at any time by contacting us at the address provided below. Please note that deactivating your account does not automatically delete your personal information. Please refer to our Privacy Policy for information about data deletion requests.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you and CreditHaven agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the State of Delaware.
CreditHaven reserves the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, you must stop using the Services and may request account deactivation.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent.
These Terms, together with our Privacy Policy and any other legal notices or agreements published by CreditHaven on the Services, constitute the entire agreement between you and CreditHaven concerning your use of the Services. These Terms supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and CreditHaven regarding the Services.
By accessing or using the Services and checking any consent checkbox or clicking any "I Agree," "Submit," or similar button, you affirmatively consent to:
You acknowledge that your electronic signature on any agreement, form, or consent constitutes a legally binding agreement to the same extent as a physical written signature.
To access, receive, and retain electronic Records, you need:
CreditHaven will notify you if our hardware or software requirements change in a way that creates a material risk that you will be unable to access or retain electronic Records. You will then have the right to withdraw your consent at no cost.

Withdrawal of consent will not affect the legal validity or enforceability of any electronic Records or signatures provided prior to your withdrawal. After you withdraw consent, CreditHaven may terminate or restrict your access to the Services if electronic delivery of Records is required for the operation of those Services.
You may request a paper copy of any electronic Record by contacting us at legal@credithaven.ai. CreditHaven will provide paper copies free of charge. We reserve the right to charge a reasonable fee for paper copies of Records that are voluminous or require significant administrative effort to produce, and we will notify you of any such fee before fulfilling the request.
It is your responsibility to keep your email address and other contact information current and accurate. You must promptly notify CreditHaven of any change to your email address or other contact information by updating your account settings or by emailing legal@credithaven.ai. CreditHaven is not responsible for any failure to deliver electronic Records resulting from an outdated or inaccurate email address.
CreditHaven will retain electronic Records for the period required by applicable law and in accordance with our data retention policies described in our Privacy Policy. You are responsible for retaining copies of any Records you receive, as CreditHaven cannot guarantee that archived Records will be available to you indefinitely.
These SMS/Text Message Terms supplement Section 6 (Electronic Communications) and govern your enrollment in and receipt of text message communications from CreditHaven.
By providing your mobile telephone number and consenting to receive text messages through the Services, you agree to receive SMS and MMS messages from CreditHaven, which may include:
Message frequency varies based on your activity on the Services and the communications preferences you select. You may receive up to 10 text messages per month from CreditHaven. Promotional messages from our partner network may be in addition to this frequency.
You may opt out of receiving SMS messages from CreditHaven at any time by replying STOP to any text message you receive from us. After we receive your STOP message, we will send you a final text message confirming that you have been unsubscribed. Following your opt-out, you will no longer receive text messages from CreditHaven unless you subsequently re-enroll.
Please note that opting out of CreditHaven's SMS messages does not automatically unsubscribe you from SMS messages sent by our partner companies. You must contact each partner separately to opt out of their communications.

Message and data rates may apply to all text messages sent to or received from CreditHaven, depending on your mobile carrier plan. CreditHaven is not responsible for any charges incurred by your mobile carrier in connection with text messages. Please contact your mobile service provider for details about your plan's messaging rates.
CreditHaven is not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission from your network operator. Message delivery is not guaranteed, and CreditHaven disclaims all liability for non-delivery, delayed delivery, or misdirected delivery of any text message.
By providing a mobile telephone number, you represent and warrant that:
You agree to indemnify and hold CreditHaven harmless from any claims, losses, or damages arising from your failure to notify us of a change in your mobile telephone number ownership.
CreditHaven's SMS program is available on most major U.S. mobile carriers, including AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, and others. Availability may vary by carrier.
